The Declaration is premised on what gun regulation is prohibited by the Second Amendment and what gun regulation is permissible under the Second Amendment.
The purpose of this email is to elicit from you as the County Attorney for Jefferson County what your views are about the Second Amendment.
To that end I would like to meet with you (or with one of your Assistant Jefferson County Attorneys) to discuss the Second Amendment.

Dear Chief Partridge,
This email is to expand my tweet reply to your May 19th tweet, in which you thanked AG Marshall for speaking at the Alabama Law Enforcement Memorial, and in my reply to which I said there is a need for public declarations that the Second Amendment does not give citizens the right to bear arms against the police.

I think many citizens believe that the Second Amendment gives them a right to stockpile weapons for use against the government for if and when those citizens think the government has become tyrannical, and believe that the Second Amendment prohibits the government from protecting itself against citizens who would use weapons to attack the government.
I contend those beliefs are mistaken.
It is one thing for citizens to have, and to act on or try to act on, those mistaken beliefs.
It is another thing for public officials, who have taken oaths of office to preserve, protect and defend constitution and the rule of f law, to have such mistaken beliefs and to act on such mistaken beliefs, such as by not contradicting citizens who have the mistaken beliefs and by encouraging citizens in their mistaken beliefs.
I think AG Marshall may have such mistaken beliefs, and he is unwilling to contradict Alabamians who have the mistaken beliefs.
You, with the help of legal counsel to the Oxford Police Department, should decide what rights you think the Second Amendment gives to citizens, and whether you think AG Marshall has mistaken beliefs about the Second Amendment and whether he is not willing to contradict Alabamians who have the mistaken beliefs.
I copied you and numerous other Alabama public officials, who are on city councils or county commissions or in law enforcement (and others), an email that I sent last October to New York sheriffs (which email is set out at https://al6thcongdist-ihaveuntiljan13.blogspot.com/2022/10/law-enforcement-preventgunviolencedecla.html).
I am copying those public officials (and others) on this email.
I plan to contact legal counsel who advise those public officials to discuss with such legal counsel what they think the Second Amendment protects and does not protect.

Thank you very much for referring my email to Mountain Brook's city attorneys.
As I say in my email to Oxford Police Chief Partridge, I believe there is a need for public declarations that the Second Amendment does not give citizens the right to bear arms against the police, and that such public declarations acknowledge that the United States Supreme Court has held that the Second Amendment gives citizens a right to own and carry guns for self-defense but also state that such right does not nullify the power of the government to keep the public safe from gun violence.

I wish to talk with Mountain Brook's city attorneys in support of a resolution by the Mountain Brook city council that embodies the public declaration idea. I am sending this email to you because an ostensible resident of Fairfield wrote me the below message:
I am a liberal gun owner that just read your letters and had to laugh a little. You live in Mtn Brook which is a fantasy village for those of us who wish to live completely outside of reality. Go. take a walk from Fairfield through Westend and on into Bham. I would love to discuss firearm ownership, restrictions, licenses and laws (many which are not enforced). I think constitutional carry should not be allowed due to what happens to minorities who are now stopped and found to have a gun. I believe in supporting my local Sheriffs office and will always purchase a CCL with a background check even though it is not longer needed. Of the 250K out of 10+ million braced guns that the ATF changed their mind on, two of the registrations were mine. My point, gun owners do not care for me due to believing in background checks, CCW's, all firearm transactions should go in front of an FFL. Liberals generally do not care for my firearm stance due to most of them thick all guns are bad and should be "taken" away. Honestly would be happy to talk about common sense control, but do not expect me to jump on your bandwagon of getting everyone everywhere to dislike them. That is about as realistic happing as if I asked you to move to Fairfield AL because there are not enough educated non-corrupt white folks there. Hope you are well and I mean no disrespect, but saw you looked at my profile, right after I posted a pellet gun pic.
If you are amenable, I would like to meet with one or more of you in person to discuss both the declaratory resolution I am seeking City Councils in Jefferson County to pass and also what is said in the above message that was sent to me.

In Alabama, the GOP controlled state legislature has statewide control over gun laws and gun regulation and it is opposed to common sense solutions for reducing gun violence. Alabama local governments are powerless as to guns in the face of the GOP state legislature control.
Maryland is auspicious for the mantra #GunsForSelfDefenseOnly getting used in shaping, advocating for, and defending in the courts, common sense solutions for reducing gun violence in Maryland.

A non-binding city council resolution urging Congress to act would be fine form.
In contrast to Maryland, my state Alabama has weak gun laws and it may be impossible to get Alabama "on board." I am nonetheless trying hard.
Getting city councils and county commissions around the country to pass resolutions as suggested will, I think, help build the public opinion for gun law changes that is needed to break the Congressional deadlock and get the changes.
If you can get other Baltimore city councilpersons and others in Maryland working on behalf of this, that would be great.
I will keep you informed of any progress I make in Alabama (or elsewhere).

A Vestavia Hills Police Department Facebook post from earlier this week (https://www.facebook.com/vestaviahillspolice) reported that Alabama Attorney General Steve Marshall made a presentation to the family of fallen Vestavia Hills Police Officer Darryl Fortner of a Certificate of "Devoted and Faithful Service." The Facebook post said, "General Marshall and his staff have worked tirelessly to support the family of Officer Fortner".
According to https://www.odmp.org/officer/reflections/26160-police-officer-darryl-wayne-fortner/25, Officer Fortner died as a result of complications from COVID-19.
I offer to you the following comments regarding (i) AG Marshall and the COVID-19 pandemic (to which Officer Fortner's death is attributable), and (ii) AG Marshall and guns and gun violence in Alabama.
COVID-19 pandemic
I have charged AG Marshall with moral depravity in his opposition to vaccine mandates. My basis for this is set out at https://al6thcongdist-ihaveuntiljan13.blogspot.com/2021/12/dear-gov-ivey-re-controlling-covid.html. AG Marshall has not responded to my charge.
In this regard, please note that the Alabama State Committee of Public Health (SCPH) has undertaken to study and evaluate the Alabama Department of Health's response to the COVID-19 pandemic, and preparedness plans for future pandemics. I would like to think that the Vestavia Hills police department and the Mayor and City Council would want SCPH to do its study well.

Guns and gun violence
In May AG Marshall spoke at the Alabama Law Enforcement Memorial. See https://twitter.com/ChiefBPartridge/status/1659619666946342923.
I sent an email to Oxford Police Chief Partridge saying that I thought there was a need for public official declarations that the Second Amendment does not give citizens the right to bear arms against the police. I elaborated on this to Chief Partridge, saying the following:
I think many citizens believe that the Second Amendment gives them a right to stockpile weapons for use against the government for if and when those citizens think the government has become tyrannical, and believe that the Second Amendment prohibits the government from protecting itself against citizens who would use weapons to attack the government.
I contend those beliefs are mistaken.
It is one thing for citizens to have, and to act on or try to act on, those mistaken beliefs.
It is another thing for public officials, who have taken oaths of office to preserve, protect and defend th constitution and the rule of law, to have such mistaken beliefs and to act on such mistaken beliefs, such as by not contradicting citizens who have the mistaken beliefs and by encouraging citizens in their mistaken beliefs.
I think AG Marshall may have such mistaken beliefs, and he is unwilling to contradict Alabamians who have the mistaken beliefs.
I am trying to implement the foregoing perspective by asking city councils in Alabama to lead against gun violence in Alabama by passing declaratory resolutions along the lines of the "Declaration of public officials for gun violence prevention" set out at https://al6thcongdist-ihaveuntiljan13.blogspot.com/2022/09/declaration-of-public-officials-for-gun.html. The reporting says Birmingham Mayor Woodfin, Birmingham City Council members, the Birmingham Police Department, the Jefferson County Sheriff’s Office and Birmingham Fire and Rescue Service were going to be in attendance at the dinner to provide support and honor mothers who have lost their children to gun violence.
For months I have been badgering Alabama mayors, city councils, county commissions, police departments and sheriff's offices about actions they could take that would contribute to the long term goal of reducing gun violence in Alabama. I say "long term goal" because (i) I believe there will be no reduction of gun violence in Alabama until there are stricter gun laws,(ii) the Alabama legislature determines Alabama's gun laws, (iii) the Alabama legislature is controlled by Republicans who are adamantly opposed to stricter gun laws, and (iv) it will take years to get stricter gun laws enacted by means of either voting such Republicans out of office or mounting public opinion sufficiently against them that they will agree to stricter gun laws.
As laid out in the foregoing link, I think mayors, city councils, county commissions, police departments and sheriff's offices can significantly contribute to advancing the long term goal of reducing gun violence, by means of their making declarations or passing resolutions along the lines of the "Declaration of public officials for gun violence prevention" set out at https://al6thcongdist-ihaveuntiljan13.blogspot.com/2022/09/declaration-of-public-officials-for-gun.html.
Making such declarations or passing such resolutions is tantamount to those parties standing up and saying to the Republicans in Montgomery, "you are wrong about gun laws; you are standing in the way of gun violence reduction in Alabama; we are standing up for our constituents and telling you this as vehemently as we can; and we will do whatever we can to get stricter gun laws enacted in Alabama."
Thus far, with two exceptions, I have gotten no response from the Alabama mayors, city councils, county commissions, police departments and sheriff's offices I have tried to contact, and I need help from other Alabamians to press those parties to do the right thing.
I have particularly tried to elicit help from Moms Demand Alabama and Faith in Action Birmingham Peacemakers.

In the "Stop The Violence Classic" news story, you commented, “There have been a couple of events at games across the state, but this is larger than that. In Birmingham City Schools since January of 2022, we have lost seventeen students to gun violence." The story goes on to report your saying "that number is unacceptable and that more must be done to end the needless loss of life."
I suggest that the Birmingham city council and the Jefferson County Commission passing the above referenced resolutions is "more [that can] be done to end the needless loss of life."

I am emailing you in your capacity as Educational Advisor to the Alabama Broadcasters Association.
This week the American Bar Association created a "Task Force for American Democracy" and published a Task Force Mission Statement that appears at https://www.americanbar.org/groups/leadership/office_of_the_president/american-democracy/overview/.
As a predicate for the Task Force, the Mission Statement says:
"Our American democracy is under threat. . .. Clearly, our American democracy is not as strong as we once thought and there are those who seem determined to push it to the breaking point. The time for answers and action is now."
The Mission Statement lists nine things the Task Force will consider and address. These nine things are:
1. Education of our citizenry on the importance of an inclusive, strong, and enduring democracy;
2. Ways to maximize voter confidence and participation in our democratic process;
3. Ways to dis-incentivize irresponsible and extremist rhetoric and positions among elected officials and candidates for elective office;
4. Ways to ensure the administration of elections remains nonpartisan;
5. Ways for ensuring the integrity and the safety of state election officials and workers across the country;
6. Ways in which the press and social media can and should contribute to the promotion and avoid denigration of our democracy;
7. The role cyberspace can play in either promoting or corrupting the American democratic process;
8. Anti-democratic weaknesses and vulnerabilities in the existing manner in which candidates for federal office are elected in this country; and
9. Potential changes in federal, state, and local practices, laws, and constitutions to meet these ends.
I am a retired lawyer and I have sent to the Alabama State Bar an email urging it to undertake supportive activities in Alabama regarding what the American Bar Association Task Force is doing. My email to the Alabama State Bar is set forth below.
I think the broadcaster members of the Alabama Broadcasters Association can help in Alabama regarding what the American Bar Association Task Force is trying to accomplish.

I am an inactive member of the Alabama bar.
Our country is being dangerously buffeted by charges and counter charges of weaponization of the justice system. This is increasing the polarization in the country, and, in this buffeting and polarization, I think it is fair to say there are forces seeking to capsize the ship of state.
In the situation, the citizens badly need leaders and institutions whom they can trust and respect.
Such institutions and leaders, however, seem hard for citizens to find.
While the Alabama State Bar is only a small "institution," I think it should consider whether it should try to be an "institution" in Alabama to whom Alabamians can listen with respect and trust related to how Alabamians respond to the "weaponization of the justice system" charges and counter charges that are buffeting the country and threatening to capsize the ship of state.
Maybe one or more of your committees and task force will undertake considering this, decide there is something the Alabama State Bar can do in the situation, and proceed to do it.

I think last week's Congressional testimony of John Durham concerning the FBI's Russia probe (video at https://www.youtube.com/watch?v=JRZbZVtdjZ0), coupled with the House censure of Adam Schiff, evidence that charges and counter-charges about "weaponization of the justice system" will be dominant in the further polarization of the U.S. during the next 15 months, and that Americans cannot look to leaders and institutions at the national level to dampen the increasing polarization leading up to the 2024 elections.
With the debilitation of leadership in America at the national level, it is second best to look for leaders and institutions in Alabama to whom Alabamians might listen with respect and trust related to how Alabamians should react to the "weaponization of the justice system" charges and counter charges that are buffeting the country and Alabama.
I have not received any response from you to my prior emails to you*, and that tends to evidence that Alabamians will not get help from Alabama leaders or institutions on this matter.

*The Clerk of the Alabama Supreme Court returned to me by U.S. mail the May 9th email that I sent by U.S. mail to the Alabama Supreme Court, with a letter saying there was no pending case on the Court's docket with my name and the Court could not take any action on my letter. I have not received any responses from you to my emails concerning the weaponization of the justice system (such emails being set out at https://al6thcongdist-ihaveuntiljan13.blogspot.com/2023/05/weaponization-of-justice-system.html).
The recently created American Bar Association Task Force for American Democracy has put forth a Mission Statement at https://www.americanbar.org/groups/leadership/office_of_the_president/american-democracy/overview/ that focuses on protecting elections in our democracy and of maximizing voter confidence and participation in our democratic process.
The Georgia situation of some Republicans wanting to discipline or remove Fulton County DA Willis in connection with her Trump indictments, and Gov. Kemp standing opposed to that (https://www.msn.com/en-us/news/politics/gov-brian-kemp-rejects-calls-to-discipline-or-remove-fulton-county-da-fani-willis-after-trump-indictment/ar-AA1g39pu), shows how "weaponization of the justice system" is at the center of the ABA Task Force for American Democracy.
On one side, Trump has been criminally charged for conduct and actions seeking to destroy our election process in 2020 and tending to destroy generally voter confidence in our elections. On this side, the criminal prosecution of Trump is critical to protect our elections from what Trump tried to do to destroy them, to deter others from trying to do similarly in the future, and to rebuild voter confidence in our elections.
From the Trump side, Trump contends that the 2020 election and democratic process were fraudulent and corrupt; voter confidence in elections was deservedly destroyed by Trump's exposing such corruption and fraud; Trump's conduct and actions were rightful to defeat the corruption and fraud in the 2020 elections and, in defeating such corruption and fraud, rightful for restoring voter confidence in our elections generally. From this Trump side, the criminal prosecution of Trump is wrongful, the criminal prosecution impairs Trump from defeating the corruption and fraud in our election system, and the criminal prosecution contributes to the continuing destruction of voter confidence in our elections. From this Trump perspective, it is critical to stop the criminal prosecution of Trump by DA Willis and Special Counsel Jack Smith.
In short, the foregoing is the epitome of the controversy of the weaponization, or not, of the justice system.
I think it clear that the ABA Task Force for American Democracy is on the side that is against Trump.
Because of the centrality of Georgia at this time, I have written the below email to the State Bar of Georgia.
I hope the State Bar of Georgia will decide that it too is on the side that is against Trump, and I hope you will decide you also are on the side against Trump side, and you will so say publicly.
