Dear chairs of Leadership Forum Selection & Program Committee, Bench & Bar Relations Committee, Government Relations Liaison Committee, and Lawyer Public Relations Task Force:
I am an inactive member of the Alabama bar.
Our country is being dangerously buffeted by charges and counter charges of weaponization of the justice system. This is increasing the polarization in the country, and, in this buffeting and polarization, I think it is fair to say there are forces seeking to capsize the ship of state.
In the situation, the citizens badly need leaders and institutions whom they can trust and respect.
Such institutions and leaders, however, seem hard for citizens to find.
While the Alabama State Bar is only a small "institution," I think it should consider whether it should try to be an "institution" in Alabama to whom Alabamians can listen with respect and trust related to how Alabamians respond to the "weaponization of the justice system" charges and counter charges that are buffeting the country and threatening to capsize the ship of state.
Maybe one or more of your committees and task force will undertake considering this, decide there is something the Alabama State Bar can do in the situation, and proceed to do it.

In March I sent you an email regarding the Alabama District Attorneys Association's public safety legislative package and my urging the Association to advocate for public officials to make a Declaration for gun violence prevention. I think last week's Congressional testimony of John Durham concerning the FBI's Russia probe (video at https://www.youtube.com/watch?v=JRZbZVtdjZ0), coupled with the House censure of Adam Schiff, evidence that charges and counter-charges about "weaponization of the justice system" will be dominant in the further polarization of the U.S. during the next 15 months, and that Americans cannot look to leaders and institutions at the national level to dampen the increasing polarization leading up to the 2024 elections.
With the debilitation of leadership in America at the national level, it is second best to look for leaders and institutions in Alabama to whom Alabamians might listen with respect and trust related to how Alabamians should react to the "weaponization of the justice system" charges and counter charges that are buffeting the country and Alabama.
I have not received any response from you to my prior emails to you*, and that tends to evidence that Alabamians will not get help from Alabama leaders or institutions on this matter.
Please consider this as mainly "for the record."

*The Clerk of the Alabama Supreme Court returned to me by U.S. mail the May 9th email that I sent by U.S. mail to the Alabama Supreme Court, with a letter saying there was no pending case on the Court's docket with my name and the Court could not take any action on my letter. The justices make public commentary from time to time (see Will Sellers, Author at Alabama Political Reporter) and I was only seeking such comment on "weaponization of the justice system" as the justices felt comfortable in making. I have not received any responses from you to my emails concerning the weaponization of the justice system (such emails being set out at https://al6thcongdist-ihaveuntiljan13.blogspot.com/2023/05/weaponization-of-justice-system.html).
The recently created American Bar Association Task Force for American Democracy has put forth a Mission Statement at https://www.americanbar.org/groups/leadership/office_of_the_president/american-democracy/overview/ that focuses on protecting elections in our democracy and of maximizing voter confidence and participation in our democratic process.
The Georgia situation of some Republicans wanting to discipline or remove Fulton County DA Willis in connection with her Trump indictments, and Gov. Kemp standing opposed to that (https://www.msn.com/en-us/news/politics/gov-brian-kemp-rejects-calls-to-discipline-or-remove-fulton-county-da-fani-willis-after-trump-indictment/ar-AA1g39pu), shows how "weaponization of the justice system" is at the center of the ABA Task Force for American Democracy.
On one side, Trump has been criminally charged for conduct and actions seeking to destroy our election process in 2020 and tending to destroy generally voter confidence in our elections. On this side, the criminal prosecution of Trump is critical to protect our elections from what Trump tried to do to destroy them, to deter others from trying to do similarly in the future, and to rebuild voter confidence in our elections.
From the Trump side, Trump contends that the 2020 election and democratic process were fraudulent and corrupt; voter confidence in elections was deservedly destroyed by Trump's exposing such corruption and fraud; Trump's conduct and actions were rightful to defeat the corruption and fraud in the 2020 elections and, in defeating such corruption and fraud, rightful for restoring voter confidence in our elections generally. From this Trump side, the criminal prosecution of Trump is wrongful, the criminal prosecution impairs Trump from defeating the corruption and fraud in our election system, and the criminal prosecution contributes to the continuing destruction of voter confidence in our elections. From this Trump perspective, it is critical to stop the criminal prosecution of Trump by DA Willis and Special Counsel Jack Smith.
In short, the foregoing is the epitome of the controversy of the weaponization, or not, of the justice system.
I think it clear that the ABA Task Force for American Democracy is on the side that is against Trump.
Because of the centrality of Georgia at this time, I have written the below email to the State Bar of Georgia.
I hope the State Bar of Georgia will decide that it too is on the side that is against Trump, and I hope you will decide you also are on the side against Trump side, and you will so say publicly.

You are the chair of the Department of Criminology & Criminal Justice at the University of Alabama, and I think it would be great if you took an interest in contributing to Alabamians being fairly informed about weaponization of the justice system.

Dear Ms. Crow, Mr. Joseph, Mr. Raleigh and Ms. Lovell:
I am writing this email to you in your capacity as members of the Judicial Conference for the State of Alabama.
The Conference has duties:
(1) To make a continuous study of the administration of justice in this state and of the organization, procedure, practice, rules and methods of administration and operation of each and all of the courts of the state; [and]
(2) To receive and consider and in its discretion investigate criticisms and suggestions pertaining to the administration of justice in the state;
Charges and countercharges of weaponization of the justice system have been flying around the country for more than a year. These have become particularly acute in connection with the New York Trump trial, with prominent Alabamians travelling to New York to make extreme public condemnation of the New York justice system.
I think it would be good for the Judicial Conference to investigate and make a determination of whether or not the justice system in Alabama has been weaponized, or is subject to potential weaponization the way it is being alleged that the New York justice system has been weaponized. After making its investigation and determination, I think the Judicial Conference should make a report of the same to the Alabama Legislature and the Alabama Supreme Court, including any recommended changes or additions to the rules of practice of the trial and appellate courts of the state that the Judicial Conference thinks are needed.

I am a retired lawyer in Alabama.
Some prominent Alabamians have recently travelled to New York to loudly condemn the New York State justice system as being weaponized.
Yesterday, I sent the below email to the Judicial Conference for the State of Alabama, saying that I thought it would be good for the Judicial Conference to investigate and make a determination of whether or not the justice system in Alabama has been weaponized, or is subject to potential weaponization the way it is being alleged that the New York State justice system has been weaponized.
I hope the Judicial Conference for the State of Alabama will consult with the New York State Bar Association Judicial Section in order to better understand whether the New York State justice system has been weaponized and, if so, what caused that in New York State, so that the Judicial Conference for the State of Alabama can better evaluate the situation in Alabama.

I am a retired lawyer in Alabama.

Subsequently I sent an email to the New York State Bar Association Judicial Section expressing hope that the Judicial Conference for the State of Alabama would consult with the New York State Bar Association Judicial Section, in order to better understand whether the New York State justice system has been weaponized and, if so, what caused that in New York State, so that the Judicial Conference for the State of Alabama can better evaluate the situation in Alabama. Yesterday Rep. Elise Stefanik filed a misconduct complaint against Judge Merchan, alleging that his selection to handle the former president’s case — and others involving his allies — is “not random at all.” Rep. On May 7th, there was this: Johnson Demands All Trump Prosecutions Cease, Vows to Use Congress 'In Every Possible Way' (thenewcivilrightsmovement.com). Speaker Johnson said:
“It has to stop. And you’re gonna see the United States Congress address this in every possible way that we can, because we need accountability. Ultimately, at the end of the day, it’s bigger than President Trump. It’s about the people’s faith in our system of justice. And we’re gonna get down to the bottom of it. All these cases need to be dropped, because they are a threat to our system.”
I hope all of the State Bar of Georgia Bench and Bar Committee, the Judicial Conference for the State of Alabama and the New York State Bar Association Judicial Section have undertaken or will undertake reviews of whether their states' justice systems have been weaponized, or are subject to potential weaponization the Republicans are alleging.
Please also consider that the American Bar Association Task Force for American Democracy will convene at the ABA's annual meeting in Chicago this August a national rule of law summit based on findings of a published Interim Task Force Report setting forth its activities, learnings, findings, conclusions, and recommendations regarding key issues such as failures to embrace and support democratic principles, threats to the rule of law, election integrity, election worker safety, extreme and violent political rhetoric, political polarization, the urgency for return to civil political discourse, and the need for civics education at all levels of public and private education. Our Work (americanbar.org). I hope many Alabama, New York State and Georgia lawyers will participate in the rule of law summit in Chicago.

Subject: Are Alabamians being fairly informed about weaponization of justice system?

Pardon this follow up email to my May 17th email to you (which email I have posted in Be An Alabama Rootstriker* with Rob Shattuck: Weaponization of justice system (al6thcongdist-ihaveuntiljan13.blogspot.com)).
There has been no responsiveness of any of the numerous parties to whom I sent the emails that are set out at the foregoing link. Perhaps that is defensible by those parties; possibly not. Also there has been no responsiveness to the emails set out at Be An Alabama Rootstriker* with Rob Shattuck: Supercharging the "rule of law" debate in Alabama (al6thcongdist-ihaveuntiljan13.blogspot.com), except that Supreme Court Justice Sellers did expressly say he would not say anything.
In any event, I am continuing and I would like to expand beyond the alleged weaponization of the justice system against Trump and to bring up alleged weaponization of the Department of Justice against lower level parties.
I personally think Merrick Garland is a person of the highest integrity and he has a paramount belief that the Department of Justice should not act with a partisan bias in enforcement of the laws. I further think that such is monumentally difficult to achieve and that Merrick Garland needs to be fairly judged on how he has done.
Over the weekend, I saw the below on Fox & Friends:
A year or so ago, you may recall how Republicans charged that Merrick Garland was "targeting" parents who were showing up at school board of education meetings to protest.
I would like the Alabama law profession to undertake a fair judging of Merrick Garland as regards the Department of Justice acting or not acting with a partisan bias in enforcement of the laws.
Please tell me, is there any professor in the University of Alabama Department of Criminology & Criminal Justice who would be willing to help me out on this?
