These two juxtaposed headlines from Alabama's https://t.co/ak3SEKc6kY show how completely we've failed on sensible gun control. Subject: Joyce Vance's "nightmare for law enforcement & citizens" of failure to have sensible gun control
Dear Professors Smolin, Horwitz, Brandon, Olree and Vars:
On January 1st, Prof. Vance tweeted about the "nightmare for law enforcement and citizens" of our failure to have sensible gun control, such tweet being sent in connection with the New Year's Eve Mobile shooting and permitless concealed carry going into effect in Alabama on January 1. https://twitter.com/JoyceWhiteVance/status/1609575631372619777
I am proceeding in 2023 with more communicating to Alabama elected officials, law enforcement, chambers of commerce, health professionals, constitutional law professors, and other Alabama parties who are (or should be) interested in ending our nightmare. https://al6thcongdist-ihaveuntiljan13.blogspot.com/2023/01/our-nightmare-of-failure-re-sensible.html.
Alabama elected officials and Alabama law enforcement who want to try to end the nightmare of failing to have sensible gun control need advice about what the Second Amendment protects and what it does not protect.
I solicit you again to offer that advice. (My previous November 8th email to you is set forth below.)
Thank you.
Sincerely,
Rob Shattuck

Professor Horwitz kindly replied to my below email and was open in expressing to me his disinclination to speak in a public way about the Second Amendment due to it being outside his constitutional law areas of focus.
That is understandable and acceptable.
Such is also a basis for sending this email to those who received the below email, in order to solicit recommendations of Second Amendment scholars in Alabama to whom my inquiry might be better directed than to those to whom I sent the below email.
Thank you for your indulgence.

Rob,
Thanks for your email and concern. Have you contacted our state representatives who voted in favor of the new gun laws most recently passed? I believe citizens should be putting more pressure on the state legislators to work towards making the state safer in the upcoming session.

Subject: Glock switches
Dear Mr. Barber and Mr. Rice:
In the article What are Glock switches? Why are we hearing about them now? Law enforcement officials argue Alabama needs new law, the two of you are identified as speaking on behalf of the Big 10 Mayors, from Auburn, Birmingham, Decatur, Dothan, Hoover, Huntsville, Madison, Mobile, Montgomery and Tuscaloosa, who have come together to call on lawmakers to pass legislation to create a state law prohibiting Glock switches and other similar devices.
The article says this about National Rifle Association opposition:
The NRA believes the Violence Policy Center (VPC), which has led an effort to prohibit all handguns, is using the unfortunate events involving Glock switches to take guns out of the hands of law-abiding citizens. In September I propounded the "Declaration of public officials for gun violence prevention" that is set out at https://al6thcongdist-ihaveuntiljan13.blogspot.com/2022/09/declaration-of-public-officials-for-gun.html.
"In District of Columbia v. Heller (2008), the U.S. Supreme Court made clear that the Second Amendment right extends to the possession and use of arms' in common use at the time' for lawful purposes like self-defense. Under any conceivable consideration, Glock pistols fall under this protection, and the Second Amendment precludes any attempt to ban them," the NRA stated last year.
The Declaration accepts that SCOTUS has held that there is an individual Second Amendment right to possess and carry a gun for self-defense but rejects that gun rights under the Second Amendment are absolute and unlimited.
The Declaration says that the Second Amendment does not give citizens the right to bear arms against the Federal, state and local governments and their law enforcement authorities. Also, the Second Amendment does not give citizens a right to bear arms for aggression and intimidation against other citizens, and that Federal, state and local governments and their law enforcement authorities have powers to prevent citizens from bearing arms for aggression and intimidation against other citizens. The Declaration further says that Federal, state and local governments and their law enforcement arms have obligations under law to protect citizens from the gun violence of others.
Since propounding the foregoing Declaration, I have been arguing that gun control advocates should adopt the mantra of #GunsForSelfDefenseOnly for formulating, advocating for, and defending in the courts, common sense gun solutions, such as prohibiting Glock switches and other similar devices. See, e.g., https://al6thcongdist-ihaveuntiljan13.blogspot.com/2022/11/gunsforselfdefenseonly.html.
In calling on Alabama lawmakers to pass legislation to create a state law prohibiting Glock switches and other similar devices, I urge the Big Ten Mayors, and their spokespersons such as yourselves, to adopt and articulate to the public the mantra #GunsForSelfDefenseOnly.
Thank you for you attention to this email.
Sincerely,
Rob Shattuck
