Local authorities for stricter gun laws

This is a continuation of Be An Alabama Rootstriker* with Rob Shattuck: Draft statement to Birmingham City Council re gun control laws (al6thcongdist-ihaveuntiljan13.blogspot.com).

Alabama local authorities (city councils, county commissions, police departments and sheriff's offices) are starting to stand up to the Republicans in the Alabama legislature who want to kill Alabamians by  blocking sensible gun laws.

This blog entry will record the developments that are going on.

Subject: Bessemer Police chief claims to be 'hindered' by permitless carry in midst of gun violence wave
Dear Bessemer Police Chief Mike Wood,
I wish to cheer you on in your publicly speaking out against permitless carry and saying to the media, ""We have been hindered by legislation that has been passed in the state of Alabama, taking away pistol permits." Bessemer Police chief claims to be 'hindered' by permitless carry in midst of gun violence wave (1819news.com).
You may be interested in the below email I sent last month to Jacksonville Police Chief Marcus Wood, who is the new president of the Alabama Association of Chiefs of Police (plus included emails).
If there is anything I can do to help you, Mayor Gulley and the Bessemer city council to reduce gun violence in Bessemer, please do not hesitate to ask me.
For your information, the numerous parties shown as being copied on this email are contacts whom I have developed in connection with my work to try to reduce gun violence, and I hope some of them will do their own cheering on of you in your speaking out publicly against permitless carry.

Subject: Birmingham's gun violence crisis and the 2024 FOOD + Culture Festival
Dear Frank (Stitt), Cathy (Sloss Jones), and Leigh (Sloss-Corra),
The extreme pain of Saturday night's mass shooting at Five Points South is wracking Birmingham.
In Sunday's press conference, Mayor Woodfin cried out for action by lawmakers. Woodfin calls on lawmakers to take action following mass shooting in Birmingham (cbs42.com)
Ever since the Galleria Mall shooting in 2018, I as a lowly citizen have been crying out for the same.
During the past year I have focused on trying to get local authorities (city councils, county commissions, police departments and sheriff's offices) to stand up to the Republicans in the Alabama legislature who want to kill Alabamians by their blocking stricter gun laws (or passing more lenient gun laws) in Alabama. My efforts in this regard are detailed at Be An Alabama Rootstriker* with Rob Shattuck: Local authorities for stricter gun laws (al6thcongdist-ihaveuntiljan13.blogspot.com)' and Be An Alabama Rootstriker* with Rob Shattuck: Draft statement to Birmingham City Council re gun control laws (al6thcongdist-ihaveuntiljan13.blogspot.com).
Saturday night's horror was in the middle of Birmingham's 2024 FOOD + Culture Festival, and you are presumably experiencing special trauma from your roles and hard work in trying to make the festival.as successful as it could be. (Frank Stitt Award (bhamfoodplus.com) and https://bhamnow.com/2024/09/13/your-guide-to-the-birmingham-foodculture-festival-sept-19-22/)
In your reaction to all of this, I would like you to think about how well (or not) Rep. Gary Palmer has served the Birmingham community as regards gun violence. For this purpose, please take a look at his 2023 interview with CBS42 at Rep. Gary Palmer on conclusion of House Speaker vote (cbs42.com) (starting at time 2:32) and his 2019 interview with Pam Huff at Rep. Gary Palmer on 2nd Amendment, Domestic Terrorism, and Solutions - YouTube.
May Saturday night's horror finally, really, mean, ENOUGH IS ENOUGH in Alabama.
Sincerely,
Rob Shattuck

Subject: Trump, football and guns
Dear Alabama TV reporters:
Trump is coming to Alabama for the football game on Saturday.
Tremulous Trump Republican toadies such as Tommy Tuberville, Katie Britt, Gary Palmer, Steve Marshall, John Wahl and Wes Allen are likely focused at this time on how they can best prostrate themselves before their orange Sun King on Saturday.
Said Republican toadies are not likely to be receptive to having serious conversations with Alabama TV reporters this week about Alabama's gun violence crisis and whether Alabama Republicans in Congress and in the Alabama legislature need to stop killing Alabamians in their opposition to stricter gun laws in Alabama (or in their loosening of Alabama's gun laws).
While Alabama TV reporters will most likely be dissed if they seek serious interviews about gun violence with Alabama Republicans this week who are in heat for Trump's attention on Saturday, Alabama TV reporters might nonetheless prepare themselves for unlikely interview opportunities by watching Gary Palmer's 2019 interview with Pam Huff at Rep. Gary Palmer on 2nd Amendment, Domestic Terrorism, and Solutions (youtube.com) and his 2023 interview with Andrea Lindenberg at Rep. Gary Palmer on conclusion of House Speaker vote (cbs42.com) (starting at time 2:32).
Good luck!

Subject: Faith leaders, Tuscaloosa police team up for Ceasefire Campaign
Dear Mayor Maddox, Tuscaloosa City Councilors, Police Chief Brantley, Pastor Ransey O'Daniel and Pastor Adam Robertson:
Numerous parties in Alabama are trying to work together to reduce gun violence, such as the joint efforts of Tuscaloosa churches and the Tuscaloosa police to "get people to put their guns down" as reported at https://www.wbrc.com/2024/08/30/faith-leaders-tuscaloosa-police-team-up-ceasefire-campaign/.
Unfortunately, the Republicans in the Alabama legislature are not joining in to do what they can do to get people to put their guns down, and instead such Republicans want more guns in people's hands for use to kill Alabamians.
In Alabama, only the Alabama legislature can pass laws that can help keep guns from getting in the hands of people and being used to kill Alabamians.
In the face of the refusal of the Republicans in the Alabama legislature to pass sensible laws to reduce the killing of Alabamians, I have been advocating for more than a year that Alabama local authorities (city councils, county commissions, police departments and sheriff's offices) publicly point fingers at the Republicans in the Alabama legislature about this, by means of such local authorities passing resolutions and issuing public statements with a view to shaming the Republicans about what they are doing to kill Alabamians. See Be An Alabama Rootstriker* with Rob Shattuck: Local authorities for stricter gun laws (al6thcongdist-ihaveuntiljan13.blogspot.com).
As the foregoing link indicates, I have contacted scores of local authorities and their personnel and other interested Alabama parties (including the below May 21, 2024, email to Tuscaloosa Assistant Police Chief Heath Clark and the Tuscaloosa City Council) in order to move my advocacy forward.
If you think my efforts are worthwhile and want to help in such efforts, please let me know.
Sincerely,
Rob Shattuck

Subject: UAB criminal justice professor weighs in on how to curb violent crime
Dear Professor Walker and Lisa Crane:
In the "stop the violence" interview of Professor Walker that is posted at UAB criminal justice professor weighs in on how to curb violent crime, the one thing that is not mentioned for helping reduce gun violence in Alabama is that of stricter gun laws.
Professor Walker is on the board of directors of Crime Stoppers of Metro Alabama (https://crimestoppersmetroal.org/about/).
I have been importuning Professor Waller to present to the board of directors that it advocate for stricter gun laws in Alabama in order to help reduce gun violence.
I have been particularly urging that local Alabama authorities (city councils, county commissions, police departments and sheriff's offices) stand up to the Republicans in the Alabama legislature who want to kill Alabamians by the blocking that the Republicans do of stricter gun laws (or their passing more lenient gun laws) in Alabama. Be An Alabama Rootstriker* with Rob Shattuck: Local authorities for stricter gun laws.
I suggest that Lisa Crane follow up on the above interview of Professor Walker and ask him where the board of directors of Crime Stoppers of Metro Alabama stands on the matter of advocating for stricter gun laws in Alabama. Then, after Lisa Crane gets an answer to that question, I suggest she press Republican lawmakers in Alabama why they want to kill Alabamians by the blocking that the Republicans do of stricter gun laws (or their passing more lenient gun laws) in Alabama.
Sincerely,
Rob Shattuck

I have made appeals to Alabama TV stations, Alabama governmental entities, the Alabama law profession, the Alabama business community, the Alabama academic community, Alabama health care professionals, and others, to improve our democratic processes and particularly to better inform Alabamians so they may more intelligently make voting decisions in the democratic process for their own benefit.  These appeals may be sampled at Be An Alabama Rootstriker* with Rob Shattuck: Getting AL TV stations to do better in 2024 elections (al6thcongdist-ihaveuntiljan13.blogspot.com); Be An Alabama Rootstriker* with Rob Shattuck: Interim Alabama report to ABA Task Force for American Democracy (al6thcongdist-ihaveuntiljan13.blogspot.com); Be An Alabama Rootstriker* with Rob Shattuck: Alabama evangelicals and "The Kingdom, the Power and the Glory" (al6thcongdist-ihaveuntiljan13.blogspot.com); Be An Alabama Rootstriker* with Rob Shattuck: UAB Critical Conversations and American Democracy (al6thcongdist-ihaveuntiljan13.blogspot.com); Be An Alabama Rootstriker* with Rob Shattuck: Draft statement to Birmingham City Council re gun control laws (al6thcongdist-ihaveuntiljan13.blogspot.com); Be An Alabama Rootstriker* with Rob Shattuck: Letter to AL State Public Health Committee (al6thcongdist-ihaveuntiljan13.blogspot.com)

I am picking up on my appeals with further emails, as set forth below:

Subject: State Bar of Georgia and ABA Task Force for American Democracy
Dear State Bar of Georgia Executive Committee:
The yearlong work of the American Bar Association Task Force for American Democracy has wrapped up for now.
ABA President Mary Smith issued an August 2, 2024, statement about the Task Force's work, which statement is posted at https://www.americanbar.org/content/dam/aba/administrative/news/2024/aba-democracy-task-force.pdf.
Quoting from the statement:
... it is imperative for the American Bar Association, and the legal profession it represents, to lead the way in fortifying our democratic institutions. We are uniquely equipped to uphold the rule of law, rejuvenate judicial norms, safeguard election integrity and protect the dedicated professionals and volunteers who uphold our legal system.
. . .
Through extensive research, community engagement via listening tours and numerous consultations, the Task Force has identified key issues undermining our democratic institutions. Notably, the rise of misinformation, the normalization of political violence and a growing disillusionment with democratic governance have emerged as critical concerns. Our observations indicate that these issues are exacerbated by a polarization that has infiltrated the very fabric of our society, making reasoned, bipartisan dialogue more crucial than ever."
Accompanying President Smith's statement is a Task Force analysis that reflects the group’s assessment of the current state of our democracy, outlines the Task Force’s activities, and sets forth specific actions lawyers and citizens can take between now and the November election to support democracy and the rule of law.
From a section of the analysis captioned "WHAT INDIVIDUAL LAWYERS CAN DO", I quote the following items:
2. Volunteer:
b. Give talks in your community and offer to write in your local newspaper about the rule of law, democracy and our elections.
c. Check in with your local bar association on where they may need help defending democracy and the rule of law.
3. Be a democracy leader in your community:
a. Stand up for our: i. Judges, court workers and our justice system ii. Election workers and election processes iii. American democracy and the rule of law.
b. Make sure you’re knowledgeable on the Constitution, the rule of law and democracy.
c. Actively dispel election misinformation and disinformation in your community as it arises.
d. Work to improve public dialogue by modeling and encouraging ways for members of your community to engage in civil and respectful discussion despite political differences.
e. Condemn violence or the threat of violence, especially as it relates to our elections and our judicial system.
f. Attend a local Braver Angels or Living Room Conversations session to help bridge the partisan divides in your community and encourage others to do so as well.
4. Share this list with your colleagues and members of the bar and encourage them to get involved in the above activities.
I am a retired lawyer in Alabama.
For a year I have been urging Alabama lawyers to undertake activities supportive of the Task Force's mission. I will continue this effort until the election and am copying on this email a number of Alabama contacts.
With less than three months to go until November 5th, I think the mission of the ABA Task Force needs as much pushing by individual lawyers as they are willing to provide. Please consider this email to the Executive Committee of the State Bar of Georgia to be in that vein.
Thank you for reading this email.
Sincerely,
Rob Shattuck

Subject: Capitol Journal's coverage of BCA Governmental Affairs Conference
Dear BCA Directors of Governmental Affairs Caroline Franklin and William Newman:
Since sending you my August 14th email (appended below) that was prompted by the Yellowhammer News article Alabama's federal lawmakers connect infrastructure as key to economic growth at BCA conference - Yellowhammer News, I have watched Todd Stacy's Capitol Journal show about the BCA conference (posted at Capitol Journal - August 16, 2024 (youtube.com)).
I think Todd's Capitol Journal show can help my objective of Alabamians being better informed about the economy and inflation so they can vote more intelligently in the 2024 election.
Anchors and reporters at Alabama TV stations should watch Todd's show to learn what Alabama's business and political leaders talked about at the conference for making Alabama and the Alabama economy better for Alabamians, the prime subjects being Alabama work force development (including education and childcare) and Alabama infrastructure (including state and local funding and public/private partnerships).
The Alabama TV anchors and reporters will learn little or nothing was said about what the United States Presidential candidates are saying about the economy or about what the Presidential candidates say they will do or try to do regarding the economy, and little or nothing was said about how the same bears on (or not) and affects (or not) what Alabama's business and political leaders talked about at the conference for making Alabama and the Alabama economy better for Alabamians.
I wish to continue to call on the Business Council of Alabama, Alabama TV stations and Alabama economics professors to think up how they can, in the next 80 days, contribute to Alabamians being better informed about the economy and inflation, so they can vote more intelligently in the 2024 election.
Thank you (and I very much hope something will be undertaken).
Sincerely,
Rob Shattuck

Subject: Alabama’s federal lawmakers connect infrastructure as key to economic growth at BCA conference
Dear BCA Directors of Governmental Affairs Caroline Franklin and William Newman:
The annual Governmental Affairs Conference of the Business Council of Alabama focused on infrastructure as a "central element to Alabama’s success in the 21st Century." Alabama's federal lawmakers connect infrastructure as key to economic growth at BCA conference - Yellowhammer News
I think Alabamians should be better informed about infrastructure as a "central element to Alabama’s success in the 21st Century", I particularly think Alabamians should be better informed about the sources of funding (Federal and local) for Alabama infrastructure and about the relationship between all infrastructure funding nationally (of which Alabama funding is a part) and the inflation that is a top issue in the 2024 election, so that Alabamians can more intelligently cast their votes in the 2024 election.
In June I wrote the below email to Alabama economics professors soliciting their involvement and the involvement of Alabama TV stations to better inform Alabamians about the economy and inflation.
This email is to solicit the involvement of the BCA in the foregoing objective.
Please let me know if the BCA is willing to participate so that Alabama voters may more intelligently cast their votes in the 2024 election
Thank you.

Subject: Alabama economics professors and civic responsibility
Dear UAB Collat School of Business Dean Shook; UA Culverhouse College of Business Dean Palan; Auburn University Economics Department Chair Ziebarth; Samford University Department of Economics, Finance, and Quantitative Analysis, Chair Jones; and University of Montevallo Stephens College of Business Interim Chair Garrity:
This email is in follow up to my April 25th email to you, which email bears the subject line "Alabama economics professors and civic responsibility," and which email can be found at Be An Alabama Rootstriker* with Rob Shattuck: Getting AL TV stations to do better in 2024 elections (al6thcongdist-ihaveuntiljan13.blogspot.com).
Here is my proposal development.
Take the inflation issue. I propose the drafting of a one page statement for TV stations to present to their viewers that sets out the causes of the inflation shown on Current US Inflation Rates: 2000-2024; positive and negative effects on the economy and otherwise accompanying the inflation; governmental action at this time that may reduce the inflation; and positive and negative effects on the economy and otherwise that may result from the governmental action.
The purpose of the statement would be to help Alabama voters better understand the inflation issue. Before being used, the statement would be circulated to Alabama's members of Congress for their views about how well the statement serves its purpose.
After the statement is finalized, participating Alabama TV stations would read the statement on one or more news shows and post the statement on their websites.
The foregoing idea is subject to any suggestions for any ways for the TV stations to better help their viewers understand the inflation issue.
Please let me know if there is an economics professor in your department who is willing to participate in this proposal.
I am copying TV stations on this email and will contact them to find out whether there are TV stations that are willing to participate.
Thank you.
Sincerely,
Rob Shattuck

Dear Dr Sutter:
This email is prompted by your article "Price gouging, inflation and the illusion of price controls" published yesterday by Yellowhammer News at Dr. Daniel Sutter: Price gouging, inflation and the illusion of price controls - Yellowhammer News.
I very much desire for Alabama voters to be better informed about the economy and inflation in order that they may vote more intelligently in the 2024 election.
I call to your attention the below email (and included emails) that I have circulated to the Business Council of Alabama, Alabama TV stations, and other economics professors in Alabama, done as part of my seeking for Alabama voters to be better informed about the economy and inflation.
To the extent you are similarly moved in favor of Alabama voters being better informed about the economy and inflation in order that they may vote more intelligently in the 2024 election, I hope you will add your efforts in this regard.
Thank you.

Subject: Regarding Tuesday and reducing gun violence
Dear Jeff,
Per our previous emails, I am available for a phone conversation anytime Tuesday (or any other day next week). My number again is 205-967-5586.
At the moment, I am particularly keen on availing of the next 65 days of the Harris-Walz campaign to publicize the cause of stricter gun laws to reduce gun violence in Alabama.
I am trying to use Harris-Walz on other important issues and to get Alabama TV stations to do a better job of informing Alabamians on these issues, so Alabama voters can vote more intelligently in the 2024 election. See Be An Alabama Rootstriker* with Rob Shattuck: 70 days to go for AL institutions to show their civic responsibility (al6thcongdist-ihaveuntiljan13.blogspot.com).
In connection with the foregoing, I have been sending emails related to the issues in question that have included Alabama TV stations, and I am copying the TV stations on this email as well.
The Board of Directors of Crime Stoppers of Metro Alabama can make a big difference for reducing gun violence by means of stricter gun laws.
The local news has been reporting on the success of Crime Stoppers and the police in getting citizens who know about crimes to come forward with the information to Crime Stoppers and the police.
If there were stricter gun laws, citizens coming forward to Crime Stoppers and the police with information about violations of the stricter gun laws would go a long way in reducing gun violence, I think.
It is up to you and the Crime Stoppers Board about how you and they want to proceed regarding what I am recommending. Please just let me know.
Thank you, Jeff.
Sincerely,
Rob

Subject: AL TV stations --Tuscaloosa debate; next week's ABC debate; next 60 days
Dear Alabama communications, journalism and other professors:
In December I sent you the below email "Assessing the performance of AL TV stations this week in connection with tonight's debate in Tuscaloosa". (UA Professor Darrin Griffin asked me to remove him from my email list, so I have not included him on this email.)
I don't know how much you care about how Alabama TV stations prove themselves in the 2024 election.
I care, per https://al6thcongdist-ihaveuntiljan13.blogspot.com/2024/08/70-days-to-go-for-al-institutions-to.html.
I hope you care too.
Thanks.

Please hone your judgments about how well former students of yours, and others, who are at Alabama TV stations have done and will do this week in connection with tonight's debate in Tuscaloosa.
I will endeavor during the next week to compile an evaluation, and I hope you will participate with me. https://al6thcongdist-ihaveuntiljan13.blogspot.com/2023/12/alabama-and-debate.html

Pushing beyond Facebook

I have had the following Facebook interchange the past few days:

From me:
As I indicated in my comments on the other post, I am trying to reach beyond Facebook posting and commenting to warn Alabamians about Trump and Project 2025, and I wish to find others interested in doing the same. Below is an email I sent yesterday in trying to advance my reaching out beyond FB. After I post this comment, I will probably tag here people I tagged in my comments on the other post, plus some, to emphasize and push more for what I am trying to do.
[referenced email is "Email to WBRC staff re: WBRC 75th anniversary, the Fourth of July, and "It was good while it lasted" that is posted at Be An Alabama Rootstriker* with Rob Shattuck: Writing for the ages (al6thcongdist-ihaveuntiljan13.blogspot.com)

From me:
Thank you very much, Bob. Possibly something can be done that will affect the 2nd Congressional district election, but otherwise no effect, as you suggest. On grounds of principle or good citizenship, I like my campaign in Alabama. I am also venturing outside of Alabama, as you are trying for. Tomorrow I will do the tagging here that I previously mentioned and may have some further suggestions to make.

From other person:
Agree. Second District is ultra-important. I really admire what you are doing. I wish everyone had as clear an understanding of our government. Oh, and by the way, I haven't given up on our state. We have a lot of work to do with the Lege.

From me:
Good afternoon, Bob. I think I will repeat the tags I made in my comments on the other post, plus some, and leave it to tagged people to decide how concerned they are about Trump and Project 2025, decide if they desire to undertake communications directed outside of Facebook, and, if so, signal that desire. I think people who have such desire can work together on this, have good ideas about things to do, and have a satisfying effect.
So here goes:
[Over 50 persons were tagged. Names not posted here.]

From me July 9: I have tried to call the attention of Greater Birmingham Democrats Mountain Brook Democrats Hoover Democrats and North Jeffco Dems to the above "Pushing beyond Facebook" link. I have not gotten any comment from them about the same.

Discussion
Having received three likes regarding the above, I will throw out ideas and suggestions here, and I solicit ideas and suggestions from others. I think the approach should be to coordinate and build on what one another is doing.
Start with the above referenced "Email to WBRC staff re: WBRC 75th anniversary, the Fourth of July, and "It was good while it lasted" that is posted at Be An Alabama Rootstriker* with Rob Shattuck: Writing for the ages (al6thcongdist-ihaveuntiljan13.blogspot.com). (In the Facebook interchange I was asked whether anyone at WBRC had responded to my email. At this time, the answer is no, no one at WBRC has responded to me.)
People can send their own emails to the TV stations. People can copy and paste my email into their own email and ask whether the addressee has responded, and, if not, why not. People can go on the Facebook pages of individual WBRC staff and post a comment that sets out my email or that makes its own appropriate comment to the staff member.
On Facebook, people can urge others to participate in this effort and post links to this page.

Constitution, Article II, Section 3. "He [President] shall take Care that the Laws be faithfully executed."
Concluding paragraph from Faithful Execution and Article II - Harvard Law Review
The original meaning of the Faithful Execution Clauses does not cleanly dispose of many of the most significant and pressing contemporary issues implicated by assertions of presidential authority. But our findings here at least suggest that the President — by original design — is supposed to be like a fiduciary, who must pursue the public interest in good faith republican fashion rather than pursuing his self-interest, and who must diligently and steadily execute Congress’s commands. Now that this original meaning is more clear, the Constitution can be applied more faithfully to the vision of the framers.

Dear Professors Leib, Shugerman, Kent, Prakash, Meyler, and Huq:
You are the three authors of, and three responders to, the June 2019 Harvard Law Review article "Faithful Execution and Article II" that is at Faithful Execution and Article II - Harvard Law Review.
The concluding paragraph of the article says:
The original meaning of the Faithful Execution Clauses does not cleanly dispose of many of the most significant and pressing contemporary issues implicated by assertions of presidential authority. But our findings here at least suggest that the President — by original design — is supposed to be like a fiduciary, who must pursue the public interest in good faith republican fashion rather than pursuing his self-interest, and who must diligently and steadily execute Congress’s commands. Now that this original meaning is more clear, the Constitution can be applied more faithfully to the vision of the framers.
I would like to think that all six of you disagree with the majority opinion in the SCOTUS Presidential immunity case and that all six of you agree with the dissent.
I would like to think there are scores of constitutional law and other professors who similarly disagree with the majority opinion in the SCOTUS Presidential immunity case and who agree with the dissent.
I hope professors who very strongly disagree with the majority opinion in the SCOTUS Presidential immunity case will join in a letter addressed to President Biden and to the Congress, calling for an expansion of the Supreme Court in order to rectify an extreme error that was made by the majority of the Supreme Court yesterday.
Thank you.

Dear Professors Bitensky, Bronsther, Chen, Greene, Kalt, Lawrence, Morag-Levine, Pucillo, Ravitch, and Sant'Ambrosio:
I am a retired lawyer in Alabama.
I am contacting you who are constitutional law professors at the Michigan State University College of Law.
I think Elissa Slotkin should make the SCOTUS immunity decision a campaign issue against Mike Rogers, in the form of her calling for an expansion of the Supreme Court.
Below is an email I sent to the three authors of, and three responders to, the June 2019 Harvard Law Review article "Faithful Execution and Article II" that is at Faithful Execution and Article II - Harvard Law Review.
My email urged that professors who very strongly disagree with the majority opinion in the SCOTUS Presidential immunity case join in a letter addressed to President Biden and to the Congress, calling for an expansion of the Supreme Court in order to rectify an extreme error that was made by the majority of the Supreme Court yesterday.
If you think Elissa Slotkin should make the SCOTUS immunity decision a campaign issue against Mike Rogers, such as in the form of her calling for an expansion of the Supreme Court, please consider you and other constitutional law professors in Michigan writing a joint letter to Elissa Slotkin setting out your argumentation for her doing that.
Thank you for reading this email.

Dear Professor Richardson:
This email is prompted by your interview last night on the PBS NewsHour discussing the Supreme Court’s immunity decision and the shift in presidential powers, which interview is at
Historian discusses Supreme Court’s immunity decision and shift in presidential powers | PBS News.
I think Democratic candidates for the United States Senate this year should make SCOTUS a campaign issue, in the form of calling for an expansion of the Supreme Court. I think such should be supported by constitutional law professors writing letters to the candidates urging the candidates to do that.
Yesterday I sent the below email to constitutional law professors at Michigan State University urging them to send a letter to the Michigan Democratic Senate candidate Elissa Slotkin to such effect.
I hope to do similarly regarding Democratic candidates for the U.S. Senate in other states and constitutional law professors in those states.
I am copying this email to Dean Lienau of the Boston College Law School, with a view that perhaps she will think constitutional law professors at the Boston College Law School might be interested in signing a letter to President Biden and the Congress calling for expansion of the Supreme Court.
I am a retired lawyer in Alabama and have been emailing university history departments and law school professors in Alabama concerning Trump and other matters. I am also copying some of those contacts on this email for pushing ahead with them.
Thank you.

Subject: WBRC 75th anniversary, the Fourth of July, and "It was good while it lasted"
Dear WBRC staff:
In this week of WBRC's 75th Anniversary (wbrc.com), and today's 248th Anniversary of the Declaration of Independence, may the staff of WBRC reflect on Josh Moon's opinion piece "It was good while it lasted" two days ago in the Alabama Political Reporter.
In Josh's words, "It [the SCOTUS immunity decision] is the sort of decision that historians note as the turning point. The thing that pushed it completely off the rails. The thing that undid it all."
Is Josh engaged in hyperbolic fear mongering?
Does WBRC have a journalistic obligation, to the best of its ability, to evaluate what the Presidential immunity decision means for the United States?
And to tell WBRC's viewers what that evaluation by WBRC is?
Please, please, do the right thing here.
Thank you.

Doing what's best for the country; bad faith

Presidential immunity case; public purpose versus private purpose; bad faith
Awaiting the decision of the United States Supreme Court this morning in the Presidential immunity case, I am thinking that each element in the case needs to be evaluated with reference to the extent to which an action (official or otherwise) is intended to serve and in fact serves a private purpose or interest versus the extent to which the action is intended to serve and in fact serves a private purpose or interest. This evaluation is very dependent on specific facts of the situation.
As an example, consider the pardon power.
The pardon power is subject to almost no limitation. The Supreme Court and the president’s pardon power - SCOTUSblog.
Suppose Putin paid Trump $50,000,000 to pardon a particular person and Trump pardoned the person. Suppose Trump could not make any showing that the pardon served any public purpose and a jury could reasonably conclude that the only reason Trump granted the pardon was for Trump to get the $50,000,000 for himself personally, and such amounted to criminal bribery. We will see whether the Supreme Court decision this morning provides a clear answer to whether a President has absolute immunity in the exercise of the pardon power, or whether, in the foregoing hypothetical, could be prosecuted criminally after he left office.
Next, consider Trump's telephone call to the Georgia Secretary of State to "find" votes for him. Trump could say that action was carrying out Presidential duties to assure that the 2020 election was not fraudulent and that the call cannot be considered by a jury as being part of the conspiracy with which Trump is criminally charged. This raises the question of Trump's intent, and a jury could conclude the telephone call was predominantly or exlusively to serve Trump's campaigning interest to win the election, Here, the Supreme Court might impose a test of "bad faith" and whether Trump saying he was carrying out Presidential duties to assure that the 2020 election was not fraudulent was in bad faith. We will see what light the Supreme Court's opinion today sheds on this question.
