Subject: Oregon Firearms Federation case and #GunsForSelfDefenseOnly
Dear Oregon Alliance for Gun Safety:
I am working hard for gun control in Alabama.
Last summer's Bruen decision made for great uncertainty about what is permissible gun regulation under the Second Amendment.
Numerous cases are working their way through the courts, which are needed to get clarity about what is permissible gun regulation.
In the case of OREGON FIREARMS FEDERATION, et al. v. TINA KOTEK, et al. (in which you are an intervenor), federal district judge Karin Immergut found that Oregon’s new gun law banning large capacity magazines and requiring residents to obtain a permit to purchase firearms does not violate the Second Amendment. In applying the Bruen case, the Judge Immergut found that the law keeps up with “the nation’s history and tradition of regulating uniquely dangerous features of weapons and firearms to protect public safety.” and that guns with high-capacity magazines are “not commonly used for self-defense, and are therefore not protected by the Second Amendment.” The judge further said, “The Second Amendment also allows governments to ensure that only law-abiding, responsible citizens keep and bear arms.”
The opposing party (Oregon Firearms Federation) said in response to the ruling that the "ruling is simple nonsense and sure to be overturned at the 9th circuit,” and that "[w]hen faced with the clear and undeniable issues about all magazines being banned and the permit system being completely unworkable, [Judge Immrgut] essentially said ‘not my problem.'” and “[w]e are sure there will be plenty of parsing of this absurd decision in the coming days, but it was clear from the very first day that [the judge] was both painfully ignorant and in the pocket of Oregon’s far left ‘Department of Justice.'” See https://thehill.com/homenews/state-watch/4098803-judge-upholds-stringent-oregon-gun-control-law-as-constitutional/.
In Alabama, unlike in Oregon, the state legislature has been engaged in loosening gun laws, and there is currently no chance of gun restrictions being enacted by the legislature.
In this inauspicious situation in Alabama, I am asking city councils and county commissions to take the lead against the gun violence culture in Alabama by passing declaratory resolutions along the lines of the "Declaration of public officials for gun violence prevention" set out at https://al6thcongdist-ihaveuntiljan13.blogspot.com/2022/09/declaration-of-public-officials-for-gun.html. In connection with the foregoing, I have been trying to promote discussion by using the mantra #GunsForSelfDefenseOnly.
I think Judge Immergut's FINDINGS OF FACT AND CONCLUSIONS OF LAW in OREGON FIREARMS FEDERATION, et al. v. TINA KOTEK, et al. will be very useful to me in my gun control work in Alabama.

Susana Schuler, WVTM President and General Manager says,
"When will those who make our laws see that this is not a second amendment right to bear arms argument."
I think the argument that Red Flag Laws do not violate the Second Amendment needs to be elaborated and put forth more forcefully.
I have been trying to do this by asking city councils and county commissions to pass declaratory resolutions along the lines of the "Declaration of public officials for gun violence prevention" set out at https://al6thcongdist-ihaveuntiljan13.blogspot.com/2022/09/declaration-of-public-officials-for-gun.html. I have previously asked the City Council and the County Commission to take the lead against the gun violence culture in Alabama by passing declaratory resolutions along the lines of the "Declaration of public officials for gun violence prevention" set out at https://al6thcongdist-ihaveuntiljan13.blogspot.com/2022/09/declaration-of-public-officials-for-gun.html. In your consideration of my request I think you should study a new survey that was taken of the attitudes on guns of young people between the ages of 14 and 30 (believed to be the first of its kind to explore young Americans' attitudes on guns).
This survey is discussed at https://www.pbs.org/newshour/show/most-young-americans-feel-unsafe-and-support-stricter-gun-laws-new-survey-shows by Professor Cynthia Miller-Idriss, American University, School of Public Affairs and School of Education Department of Justice, Law and Criminology. The survey should be very thought provoking for you.
I particularly call to your attention that, in the survey, 22 percent said they believe the Second Amendment gives individuals the right to overthrow the government.
That survey result should force you to decide whether or not you, as elected public officials, believe the Second Amendment gives individuals the right to overthrow the government.
I contend that such a belief negates the rule of law, and that you, as elected public officials, have a duty to defend the rule of law and, in the instant circumstances, defend it publicly by declaring your belief that the Second Amendment does not give individuals the right to overthrow the government.
